Terms of Service

These Terms of Service (“Terms”) govern your use of aloud, a voice journaling app for iOS (“aloud”, “the app”, “we”, “us”, or “our”), operated by Bautista Tancredi, an individual based in Argentina.

By downloading, accessing, or using aloud, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

1. What aloud is

aloud lets you speak for a couple of minutes about your day and turns that reflection into an organized, private journal — with automatic titles, summaries, topics, emotional-state and energy labels, insights, and memory search over your past entries.

aloud is a personal reflection tool. It is not a medical device, and it does not provide medical, psychological, therapeutic, or professional advice. The emotional-state and energy labels, insights, and reflections it generates are for personal observation only and must not be relied on as a diagnosis or as guidance for any health decision. aloud is not a crisis or emergency service. If you are in distress or think you may harm yourself or others, contact your local emergency services or a qualified professional immediately.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use aloud. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your account

aloud uses Sign in with Apple to create your account. You are responsible for maintaining the security of the Apple ID used to sign in and for all activity under your account. Notify us at hello@usealoud.app if you believe your account has been compromised.

4. Your content

You own your content. Your recordings, transcripts, and the entries generated from them (“Your Content”) belong to you. We do not claim ownership of them.

To operate the app, you grant us a limited, non-exclusive license to store, process, transcribe, analyze, and display Your Content solely to provide aloud’s features to you — for example, transcribing recordings, generating summaries and insights, and enabling memory search. This license exists only so the app can function and ends when you delete the content or your account. We do not use Your Content for advertising, we do not sell it, and it is not used to train third-party AI models (see the Privacy Policy for details on the providers we use).

You are responsible for Your Content and confirm you have the right to record and submit it.

5. Acceptable use

You agree not to:

• Use aloud for any unlawful purpose or to record others without any consent required by law;
• Attempt to access other users’ data or to breach the app’s security;
• Reverse engineer, decompile, or interfere with the app except as permitted by law;
• Use automated means to overload or disrupt the service; or
• Resell, sublicense, or commercially exploit the app or its content.

We may suspend or terminate access that violates these Terms.

6. Subscriptions, trials, and billing

aloud offers premium features through auto-renewing subscriptions, which may include a free trial followed by a monthly or annual plan.

• Billing through Apple. All purchases are processed by Apple through your Apple ID via In-App Purchase. We do not receive or store your payment details.
• Free trial. If a subscription includes a free trial, any unused portion of the trial is forfeited when you purchase a subscription.
• Auto-renewal. Subscriptions renew automatically at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
• Managing and canceling. You can manage or cancel your subscription anytime in Settings → your Apple ID → Subscriptions on your device. Deleting the app does not cancel a subscription.
• Prices. Prices are shown in the app before purchase and may vary by region and change over time; we will obtain your consent for a price increase where required.
• Refunds. Purchases are handled by Apple and are subject to Apple’s refund policies. We generally cannot issue refunds directly; refund requests go through Apple.

Access to premium features depends on an active subscription. Features may be added, changed, or removed over time.

7. Intellectual property

The app itself — its software, design, branding, the “aloud” name, and its content other than Your Content — is owned by the operator and protected by intellectual-property laws. These Terms grant you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, in accordance with the App Store Terms of Service. No other rights are granted.

8. Third-party services

aloud relies on third-party providers (including Apple, Convex, OpenAI, Anthropic, Clerk, Superwall, TelemetryDeck, Sentry, Expo, and Resend). Your use of the app is also subject to Apple’s applicable terms. We are not responsible for third-party services’ own acts or outages, but we choose providers carefully and describe their role in our Privacy Policy.

9. Disclaimers

aloud is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Automatically generated transcripts, summaries, labels, and insights may contain errors and should not be relied upon as accurate or complete. We do not warrant that the app will be error-free or always available.

10. Limitation of liability

To the maximum extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) aloud. To the extent liability cannot be excluded, the operator’s total liability is limited to the greater of the amount you paid for the app in the twelve months before the claim, or USD 50.

11. Termination

You may stop using aloud and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or if required by law. On termination, your license to use the app ends; provisions that by their nature should survive (ownership, disclaimers, liability limits, governing law) will survive.

12. Changes to these Terms

We may update these Terms as the app evolves. If we make a material change, we will update the “Last updated” date and, where appropriate, notify you in the app. Continued use after a change means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the Argentine Republic, without regard to conflict-of-law rules. The courts located in Argentina will have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights available to you in your country of residence.
